This text focuses on the issues that surround the prosecution and defence of those charged with sexually abusing a child. It addresses the investigative, preparation and trial processes. The first part of the book examines how to conduct investigations in order to verify allegations of abuse. Included are guidelines to follow when interviewing children or assessing such interviews and factors to consider when assessing the child's credibility. Situations commonly thought to lead to the making of false allegations and behavioural indicators of sexual abuse are identified and discussed. The second part offers suggestions on how to create an atmosphere of fairness to the accused while minimizing the potential trauma to the child at both the preparation and trial stages. The third part covers pre-trial considerations including disclosure requirements. Likely themes and strategies that both the Crown and defence counsel may develop at trial are also discussed.
