Rara edição de 1700 publicada em Lyon, França. Este livro inclui também os comentários e anotações ao tratado de Molina de José Maldonado y Pardo, publicadas pela primeira vez em Madrid, em 1667. A primeira edição da obra data de 1573, publicada em Alcalá de Henares por Andrés de Angulo. Obra jurídica fundamental do século XVI sobre o conceito de primogenitura e morgadios em Espanha. Este tratado tornou-se uma referência essencial para advogados e tribunais na Península Ibérica, com validade prática ininterrupta até à promulgação da lei de 27 de setembro de 1830 (restabelecida em 30 de agosto de 1836) sobre a abolição dos morgadios e de outras formações e instituições feudais em Espanha; e em Portugal, pela Carta de Lei de 19 de Maio de 1863, durante o reinado de D. Luís I. A obra de Molina permanece um testemunho jurídico valioso de um sistema que marcou profundamente a história e a sociedade ibérica, ao longo de mais de quinhentos anos. «De Hispanorum Primogeniorum Origine ac Natura» surge num contexto de desenvolvimento da literatura jurídica sobre os morgadios, que pretendia sistematizar e dar resposta às necessidades práticas dos tribunais e dos profissionais do direito. O tratado, pioneiro no seu género, não só oferece uma análise detalhada dos aspetos legais, mas também contextualiza historicamente as práticas de herança, pelo que se tornou uma ferramenta indispensável para a prática jurídica, durante séculos. Como os morgadios não eram uma instituição exclusiva da Península Ibérica, mas sim um sistema com paralelos em outros países europeus, como o entail e primogeniture na Inglaterra e o regime de substitution fidéicommissaire na França, a obra acabou por ter um impacto transnacional. As várias edições publicadas em França, na Alemanha e em Itália, assim como as «Additiones» à obra de Molina, publicadas em França, corroboram que o debate legal em torno dos morgadios ia além da Península Ibérica. Caso notável que demonstra a vitalidade da obra, foi a sua utilização como fonte para a elaboração do Código Civil chileno de 1855, por Andrés Bello. É importante notar que existe uma confusão frequente entre Luis de Molina y Morales, o autor do presente tratado, e o teólogo jesuíta Luis de Molina, que viveu no mesmo período. O jurista Luis de Molina y Morales nasceu em Osuna, na Andaluzia, enquanto o teólogo Luis de Molina nasceu em Cuenca. O teólogo é conhecido pela sua obra sobre a graça e o livre arbítrio,«Concordia Libri Arbitrii cum Gratiae Donis», um trabalho fundamental na história do pensamento teológico. A confusão entre estes dois autores é comum, mas as suas áreas de especialização e as suas obras são distintas. Right of withdrawal
If you are a consumer you can withdraw from the contract in accordance with the following. Consumer means any natural person who is acting for purposes which are outside his trade, business, craft or profession.

Statutory right to withdraw
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good or the last lot or piece.
To exercise the right of withdrawal, electronically fill in and submit a clear statement on our website, under "My Purchases" in "My Account". We will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to withdraw from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to Livraria Castro e Silva, Lisboa, Portugal, +351 213467380, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
- The delivery of newspapers, journals or magazines with the exception of subscription contracts; and
- The supply of digital content which is not supplied on a tangible medium (e.g. on a CD or DVD) if you accepted when you placed your order that we could start to deliver it, and that you could not withdraw once delivery had started.
