CUJAS, Jacques (1522-1590), hochgelehrt und hochgeschätzt, war der bedeutendste französische Jurist. Cujas studierte in seiner Geburtsstadt Toulouse Rechtswissenschaft und hielt ab 1547 Vorlesungen zu den Justinianischen Institutionen. 1554 bewarb er sich dort erfolglos um den Lehrstuhl für römisches Recht. Der Widerstand gegen Cujas war vor allem von Jean Bodin (1529/30-1596) organisiert, der die neue Lehrmethode des mos gallicus ablehnte. Cujas wandte sich ins nahegelegene Cahors, wo er die Professur von Antonius Goveanus (1505-1566) übernahm. Cujas verließ diese Universität nach nur neun Monaten, weil ihn im Juli 1555 der Ruf an die damals berühmteste Rechtsfakultät Europas in Bourges erreichte. Dort wurde er Nachfolger auf dem Lehrstuhl von Francois Baudouin (Franciscus Balduinus, 1520-1573), der sich aus religiösen Gründen gezwungen sah, Frankreich zu verlassen. Cujas war in Bourges der Konkurrenz von Hugo Donellus (1527-1591) und Franciscus Duarenus (1509-1559) ausgesetzt. Diese veranlassten während einer Pariser Bibliotheksreise von Cujas in den Monaten April bis Juni 1557 die Studenten, Bittschriften an den städtischen Magistrat einzureichen, um eine Rückkehr Cujas zu verhindern. Bei seiner Ankunft war die Unruhe in Bourges schon so groß, dass er die Stadt verließ und eine Professur in Valence annahm. Dort schrieb er auch die ersten Bücher seiner observationes et emendationes, seines opus incomparabile. Nach dem Tode von Duaren 1559 kehrte Cujas nach Bourges zurück. 1566 wechselte er an die Universität von Turin, die damals in französischem Besitz war. 1567 nahm er einen Ruf an die Universität von Valence an, die durch die Vereinigung mit der Universität Grenoble erheblich an Bedeutung gewonnen hatte. Überraschenderweise kehrte Cujas im Juni 1575 an die Universität Bourges zurück, obwohl ihm eine Vertragsverlängerung zu glänzenden Bedingungen in Valence angeboten worden war. Möglicherweise bewegten ihn aufkeimende Auseinandersetzungen zwischen Protestanten und Katholiken zur Rückkehr ins rein katholische Bourges. Seine großen Rivalen Donellus und der Nachfolger von Duaren Francois Hotman (1524-1590) waren nach der schrecklichen Bartholomaeusnacht 1572 aus Bourges geflüchtet. Dort starb Cujas am 4. Oktober 1590. Sein Haus in Bourges ist heute Museum. Sein Gesamtwerk (opera omnia) sollte Grundaustattung jeder rechtshistorischen Bibliothek sein. Im Jahre 1577, Cujas war 55 Jahre alt, erschien bei Sebastian Nivellius in Paris in fünf Foliobänden erstmals seine Opera omnia: de iure fecit in hunc diem, von Cujas selbst zusammengestellt und redigiert. Seine berühmten Observationes hatten gerade das Buch 20 erreicht. Der Verkauf war so erfolgreich, daß eine Nachdruck in den Jahren 1583-84 erschien. Im Jahre 1658 wurde das Gesamtwerk von Cujas seine opera priora (zu Lebzeiten erschienene, Bände 1-3) und die opera posteriora (opera postuma) in 10 Bänden Annibal Fabrot neu geordnet. Diese Opera omnia wurden Grundlage und Druckvorlage aller späteren Gesamtausgaben von Cujas. You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good or the last lot or piece.
To exercise the right of withdrawal, electronically fill in and submit a clear statement on our website, under "My Purchases" in "My Account". We will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to withdraw from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to Vico Verlag und Antiquariat Dr. Otto, Frankfurt am Main, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
- The delivery of newspapers, journals or magazines with the exception of subscription contracts; and
- The supply of digital content which is not supplied on a tangible medium (e.g. on a CD or DVD) if you accepted when you placed your order that we could start to deliver it, and that you could not withdraw once delivery had started.
