Paperback. Himanshu Soni's The Metaphysical Foundations of Criminal Law presents a rigorous Advaita Vedanta inquiry into the philosophical assumptions that underlie modern criminal jurisprudence. Across eight essays, the book dismantles the foundations of criminal liability-the self, doership, action, and karma-through a close engagement with the Ashtavakra Gita, Sakaracarya's Vivekacuamai, and Gauapada's Maukya Karika. It then reconstructs a positive vision of justice grounded in liberation (moka), dharma, and a forward-looking dharmic jurisprudence. This work does not reject criminal law, but challenges its unexamined metaphysical assumptions, offering a profound philosophical intervention into both Western legal theory and contemporary Indian legal thought. Across eight essays, the book dismantles the foundations of criminal liability—the self, doership, action, and karma—through a close engagement with the Ashtavakra Gītā, Śaṅkarācārya’s Vivekacūḍāmaṇi, and Gauḍapāda’s Māṇḍūkya Kārikā. It then reconstructs a positive vision of justice grounded in liberation (mokṣa), dharma, and a forward-looking dharmic jurisprudence.
This work does not reject criminal law, but challenges its unexamined metaphysical assumptions, offering a profound philosophical intervention into both Western legal theory and contemporary Indian legal thought.
