A landmark Gold Rush satire, and the most popular of California pictorial letter sheets. James Mason Hutchings was something of a Christian activist and was particularly involved in the Sabbath movement, urging church attendance and for businesses in mining districts to close for the day (their "indiscretions" are lampooned here in Commandment IV). He originally wrote the text of The Miner's Ten Commandments in response to this and other generally "sinful" behavior around the mines, and published it in the Placerville Herald. When Hutchings saw that other newspapers were pirating the text he decided to secure his copyright by publishing it as a letter sheet. He eventually had thousands of copies produced, going from mining camp to mining camp, selling them himself. This is the first of three editions of this enormously successful letter sheet (Hutchings himself claimed that he sold 97,000 copies in a year), with the apostrophe between the R and S of "Miner's." This letter sheet launched Hutchings' publishing career, which would include dozens more letter sheets, broadsides, periodicals, and books. This letter sheet prints the three-column text of the "commandments" surrounded by woodcut scenes of each, the illustrations drawn by the talented Harrison Eastman. Samples of the commandments include "Thou shalt have no other claim than one," "Thou shalt not remember what thy friends do at home on the Sabbath day," "Thou shalt not kill thy body by working in the rain," and "Thou shalt not tell any false tales about 'good diggings in the mountains.'" Of particular interest is the cameo appearance at the head of the broadside by the "elephant," an important gold rush icon, pointing with his trunk to the commandments posted on a cabin. According to the brief introductory legend, the prospecting Moses of these commandments encountered an elephant who led him to the commandments, which were tacked on a shingle. In Gold Rush iconography, seeing the elephant meant "seeing it all," leading one to surmise the chosen miner was anything but green. This copy is postmarked and addressed on the integral blank to Sherman Adams, Westfield, Massachusetts. Sherman Adams founded the library at Westfield State University while a student there in 1858, which was known as the Sherman Adams library until it was renamed for Massachusetts Governor Joseph Ely in the mid-20th century. After graduating, Adams became owner of the Westfield News Letter. It is uncommon to find such letter sheets that were actually used and sent through the mail, as this copy was. Statutory Right to cancel
You have the right to cancel this contract within 14 days for any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the the last good or the last lot or piece.
To exercise the right to cancel, you must inform us, William Reese Company, 14 East 60th Street, Suite 800, 10022, New York, New York, U.S.A., of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory. You can also electronically fill in and submit a clear statement on our website, under "My Purchases" in "My Account". If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. by e-mail) without delay.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel with contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us or William Reese Company, New York, New York, U.S.A., without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
