In-8° (200x115mm), pp. (10), XXXIV, 904, (16), 32, (108) di indici bicolonni degli scrittori menzionati nel testo e delle cose notabili, legatura coeva p. pergamena rigida con unghie e tracce di titolo manoscritto in antico alla cuffia superiore. Tagli azzurri, sguardie in decoro policromo a piuma di pavone. Ritratti calcografico di Grozio all'antiporta e frontespizio egualmente in calcografia con varie figurazioni allegoriche. Titolo in rosso e nero con marca tipografica con una sfera armillare tra il Tempo ed Ercole ed il motto Indefessus agendo. Capilettera ornati, privilegi preliminari e riproduzione della dedica di Grozio a Luigi XIII; il testo di Grozio reca, in calce, su due colonne, le annotazioni di Johannes Fredericus Gronovius (1611-1671). Ottimo esemplare con usuali quanto leggere bruniture. Firme ottocentesche e novecentesche di privato possesso. Bella ristampa di Amsterdam del capolavoro di Grozio, opera fondante del giusnaturalismo moderno (l'opera occupa le pp. 1-903), seguita da altre opere del grande giurista olandese: Commentatio in Epistolam Pauli Apostoli ad Philemonem, De Mari Libero, De Aequitate, Indulgentia, et Facilitate, Liber singularis (il trattato era stato dato alla luce da Nicolas Blankaart; Nicolaus Blancardus, Belga-Leidensis, è codice autoris descripsit, & vulgavit). Il De Jure Belli fu steso da Grozio nel periodo del suo esilio parigino e dato alle stampe nel 1625 per i tipi di Nicolas Buon; in una serrata indagine sui fondamenti dell'autorità statale Grozio confuta le basi teologiche della stessa e, in un'età lacerata dalle guerre di religione, cerca invece di porla su principi razionali e naturali. Il diritto pubblico, nella sistematizzazione di Grozio, diventa una scienza deduttiva simile alla matematica; lo stato di natura, con l'associazione tra individui fondata sulle mere leggi naturali, precede sempre e comunque lo stato politico, che, tuttavia, nel suo costituirsi, deve ispirarsi al modello naturale rispettandone le leggi di base. Scrive il P.M.M.: This wat the first attempt to lay down a principle of right, and a basis for society and government, outside Church and Scripture. Fra le scritture che seguono il De Jure Belli ac Pacis è particolarmente importante il De Mari Libero, grande classico del diritto marittimo internazionale impresso per la prima volta nel 1609. L'opera, importantissima summa delle teorie groziane sulla libertà di navigazione e di commercio, fu concepita come capitolo del De Jure Praedae, un libro scritto nel 1606 ma rimasto inedito sino al 1868. Avvalendosi di raffinate argomentazioni attinte alle teorie giusnaturalistiche, Grozio caldeggia la libertà di navigazione delle nazioni, segnatamente dell'Olanda, i cui pescatori operavano in prossimità delle coste inglesi, e della Compagnia Olandese delle Indie Orientali, ingaggiata in una disputa territoriale nei Caraibi con i mercanti portoghesi. Da notare che il volume fu aspramente attaccato da Selden nel suo Mare Clausum. In seguito la disputa avrebbe avuto importanti implicazioni economiche, in quanto la Repubblica Olandese sostenne l'idea del libero scambio nonostante avesse imposto il proprio monopolio sul commercio della noce moscata e dei chiodi di garofano alle isole Molucche, mentre L'Inghilterra nel 1651 adottò il Navigation Act, con il quale consentì l'ingresso nel paese solo dei prodotti trasportati dalle navi inglesi; tali dispute connerciali condussero allo scoppio della Prima Guerra Anglo-Olandese (1652 -1654). Right of withdrawal
If you are a consumer you can withdraw from the contract in accordance with the following. Consumer means any natural person who is acting for purposes which are outside his trade, business, craft or profession.
Information regarding the right of withdrawal
Statutory right to withdraw
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good or the last lot or piece.
To exercise the right of withdrawal, electronically fill in and submit a clear statement on our website, under "My Purchases" in "My Account". We will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to withdraw from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to Gilibert Libreria Antiquaria (ILAB), Torino, Italy, +39 0115619225, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
- The delivery of newspapers, journals or magazines with the exception of subscription contracts; and
- The supply of digital content which is not supplied on a tangible medium (e.g. on a CD or DVD) if you accepted when you placed your order that we could start to deliver it, and that you could not withdraw once delivery had started.
