-
scope of application The following general terms and conditions (GTC) apply to the sale of goods and the provision of services:
Versand-Antiquariat Treptower Buecherkabinett represented by Mrs. Volha Schultz, hereinafter referred to as seller. These general terms and conditions become part of all contracts and also apply to all future business relations, even if the general terms and conditions are not expressly agreed again. Conflicting general terms and conditions or deviating counter-confirmations shall only be recognised if we expressly confirm them in writing. The following general terms and conditions apply exclusively to the internet business relationship between customers and the Antiquariat Treptower Buecherkabinett (hereinafter called dealer) via the website abeebooks.com within the framework of the conditions established by the website operator. -
sales contract
By bidding on this item, the bidder accepts our terms and conditions.
The purchase contract is only concluded when the availability of the book has been confirmed by the Treptower Bücherkabinett. Since the books are offered on different platforms, it may happen that an already sold book is still displayed as available on another platform despite the greatest possible care.
Delivery is always subject to confirmation. If a book is not available for the above-mentioned or other reasons, compensation or other compensation for non-deliverable goods is excluded.
The contract of sale with buyers not resident in the EU is concluded subject to the granting of an export licence for cultural goods by the relevant authorities, should this be necessary in accordance with the applicable Council Regulation (EC) No 116/2009 on the export of cultural goods. If this approval is not granted, the buyer can withdraw from the sales contract with exemption from all claims for damages. In the event of this, the seller is obliged to inform and prove this to the buyer.
All agreements must be made in writing. This also applies to collateral agreements and assurances as well as to subsequent changes to the contract. If the buyer is in default with the payment of the purchase price, the seller is entitled, without further reminder, to sell the object of purchase immediately elsewhere or have it auctioned, without the buyer being entitled to any claims for damages whatsoever. The buyer is obliged to inform the seller of changes of address. Availability must be ensured (by e-mail or post). If the shipment cannot be delivered or the customer cannot be found, the customer has to bear the shipping costs again as well as any subsequent costs, e.g. costs for redirection or a new journey. Especially for foreign bank transfers, the transfer fees are to be borne in full by the buyer, so that no disadvantages arise for the seller, this also applies to all refunds and credits. Consumers within the meaning of the GTC are natural persons with whom a business relationship is entered into without the latter being attributable to a commercial or self-employed professional activity. If the buyer is a commercial merchant, he must inform us of this in writing when concluding the purchase contract. The purchase price is due immediately upon conclusion of the contract. Payment shall be made in advance or by invoice, subject to the following provisions. The prices are given in EURO and include the legal VAT of the time 7% and 19% respectively.
3 Retention of title:
We reserve title to the delivered goods until all claims against the customer arising from the business relationship, including future claims arising from contracts concluded at the same time or later, have been settled in full. This also applies if individual or all claims of the seller have been included in a current account and the balance has been drawn and accepted. The prices include the statutory value-added tax, if applicable. The contract is concluded with the order by the customer and our delivery of the goods. The contract language is German.
- storage of contracts
The contract texts (e-mails etc.) are not stored separately by the merchant and cannot be made accessible to the customer. If the buyer is interested, he should save the data himself.
The company w+h GmbH is commissioned to process data. For this
a valid order data processing contract exists in accordance with the
European Data Protection Ordinance (DSGVO). The company w+h GmbH
stores your data in the invoicing software, among other things,
in the online order management and tracking system (order control) and with
automatic processing - liability for material defects, limitation of warranty claims and further liability
The warranty period for consumers is two years from the date of delivery, otherwise twelve months for entrepreneurs from the date of delivery. Section 373 HGB only applies to merchants. The buyer purchases the goods according to the description in our auctions and in the shop. The objects of purchase are often used for centuries. Signs of wear and age-related traces give the goods a unique character. The actual condition of the goods as depicted and described shall therefore be deemed to be the agreed quality. Insofar as defects of the goods are listed in the product description which no longer correspond to the normal condition of a used item, but are basically suitable to impair the value of the goods, the goods are purchased in accordance with the information in the product description, so that a warranty is excluded in this respect. The description of the object of purchase does not constitute a guarantee within the meaning of §§ 443 BGB. This applies in particular to the information on completeness and condition, which in principle are to be regarded as expressions of opinion and not as assertions of facts. The information in the description text was provided by the seller to the best of his knowledge and belief. In the event of a defect, i.e. a deviation from the contractually agreed quality of the goods, and comprehensible written proof of defectiveness within the statutory warranty period, the following provisions on the consequences of return shall apply to the reversal. In addition, the statutory warranty provisions shall apply, i.e. the buyer may, for example, also demand a reduction in the purchase price. Further claims of the buyer - on whatever legal grounds - are excluded. We are therefore not liable for loss of profit or other pecuniary loss of the buyer.
The dealer is not liable for consequential damage caused by a defect, in particular liability for lost profit and other financial losses is excluded. The same applies to the personal liability of vicarious agents, employees and representatives of the dealer, which the dealer has used for business transactions. Liability for personal injury as well as liability for intent and gross negligence remain unaffected by these restrictions. This shall also not affect claims of the customer under §§ 1, 4 of the Product Liability Act and claims arising from warranty obligations and guarantees assumed by the dealer for the quality of the goods.
The legal regulations apply.
6.shipping costs.
Shipping within Germany by insured package for 6,50 €. Within the EU shipping costs for insured parcel 15,50 Euro.
The shipping flat rates are based on shipments with an average weight. If the book you have ordered is particularly heavy or bulky, we will inform you of any additional shipping costs. The delivery takes place in the rules within 3 days after receipt of payment.
If an item is not or not immediately delivered, you will receive a message and can then change or cancel your order.
- export regulations and customs requirements
(1) Within the framework of the export licences for cultural goods (§ 24 KGSG and EU Council Regulation (EC) No. 116/2009 on the export of cultural goods) as required by the Cultural Goods Protection Act (Kulturgutschutzgesetz), the seller shall obtain the necessary export licences for cultural goods if the goods are dispatched by the seller to the recipient country. If the goods are handed over or shipped within Germany, the buyer is responsible for obtaining the export permit.
(2) The buyer observes the import regulations of the country to which the goods purchased by him are delivered on his behalf. The seller is expressly not liable for losses, damages, delays or confiscations resulting from non-compliance with the applicable import regulations. Customs duties and import taxes are borne by the buyer.
8 Online Dispute Resolution
The European Commission provides an online dispute resolution (OS) platform provided by the European Commission at http://ec.europa.eu/consumers/odr.
- place of jurisdiction, applicable law
In fully commercial transactions, the place of performance for both parties' obligations shall be the place of business of the dealer and the place of jurisdiction for both parties Berlin. German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
