It is with great pleasure that we present this Liber Amicorum - Volume II on the year of Ian Stewart Forrester QC LL.D.'s 70th birthday and at this point of transition in his extraordinary professional life. Following the success of Liber Amicorum - Volume I, this Volume II pays tribute to Ian outstanding career offering a unique combination of contributions that tackle some of the most stimulating and current topics in competition policy and antitrust laws. Born in Glasgow from a Scottish family, Ian practiced law in multiple cities, Brussels, New York and London, to mention some. Ian arrived in Brussels in 1973 as one of the first generation of UK lawyers at the time when the UK joined the European Union. He participated in many of the leading cases in the formation of key principles of EU law, particularly EU competition law such as Bosman, Bullock (Distillers), GSK, Servier, Pfizer, Magill, IMS Health and Microsoft. Ian lived these cases professionally and academically, debating these and other cases with students, professors and researchers. He has been a mentor to many younger lawyers and is also a prolific writer of seminal articles. His good spirits and quirky sense of humour have made him friends and professional connections all over the world and this Liber Amicorum - Volume II is an occasion to mark the outstanding merits of a remarkable man and express the long lasting and affectionate friendship.
About the Authors:
The Rt Hon Sir David Alexander Ogilvy Edward KCMG PC QC FRSE is a Scottish lawyer and academic, and former Judge of the Court of Justice of the European Communities. He is an Honorary Fellow of University College, Oxford; Honorary Professor of the University of Edinburgh and Fellow of The Royal Society of Edinburgh. Sir David is an Honorary Sheriff of the Sheriffdom of Tayside, Central and Fife at Perth, Scotland.
Jacquelyn MacLennan’s practice focuses on EU and UK competition law. She regularly appears before the EU Commission and UK Competition and Markets Authority, and litigates before the EU and UK courts. She has particular expertise in developing strategy for and running defences in major international cartel investigations, and related damages actions in different jurisdictions. Most recently she has been involved in the multi-jurisdictional LIBOR, LCD, CRT and GIS investigations and litigations. She also handles investigations and advises on complex distribution problems and licensing arrangements, abuse of dominance cases, mergers and joint ventures. Clients describe Jacquelyn as "excellent – an industry leader in antitrust matters" and "commercially-minded and solution-oriented." (Chambers Europe, 2016). She is a visiting fellow at Edinburgh University’s Europa Institute, was recently awarded “Best Lawyer in Competition & Antitrust” by Euromoney Women in Business Awards, and is included in Global Competition Review’s 100 Elite Women in Antitrust. She formerly headed White & Case’s European Competition Practice and is now head of the firm’s Global Pro Bono Practice".
Dr Assimakis Komninos is a Partner at the Brussels office of White & Case LLP. Between 2009 and 2011 he was a Commissioner and Member of the Board of the Hellenic Competition Commission (HCC). He has acted before the European Court of Justice in Syfait v. GlaxoSmithKline and Lélos v. GlaxoSmithKline (parallel trade of pharmaceuticals - abuse of dominance), and in GlaxoSmithKline Services v. Commission (parallel trade of pharmaceuticals - Article 101). He was also involved before the EU General Court in Microsoft v. Commission (compulsory licensing of interoperability information), GlaxoSmithKline Services v. Commission (parallel trade of pharmaceuticals - application of Article 101), Chalkor Metal Works v. Commission (copper plumbing tubes) and Public Power Corporation v. Commission (Greek lignites). Dr Komninos successfully represented Aegean Airlines as lead counsel in Aegean/Olympic II, which resulted in the European Commission clearing the deal two years after it had previously blocked it. He has also represented or advised clients in proceedings before the Albanian, Cypriot, French, Greek, Kosovo and Romanian competition authorities and Belgian, Bulgarian, Cypriot, French, Greek, Latvian and Spanish appellate courts, and has particular expertise in arbitration cases involving EU and national competition issues, and in private antitrust litigation cases in national courts. Dr Komninos is currently a visiting fellow of the Centre for Law and Governance in Europe at University College London (UCL), where he teaches EU competition law, and a senior associate fellow of the Institute for European Studies (IES) at the Vrije Universiteit Brussels (VUB).
