Paperback. Most legal trouble in engineering does not arrive as a collapse. It arrives as a letter: a notice served two days late, a claim for prolongation, a request that a certificate be revised, a demand under a bond. Engineers are expected to handle these moments competently, usually without legal support and often without ever having been taught the underlying rules. The vocabulary is unfamiliar, the consequences are immediate, and the instinct to defer to whoever in the room sounds most certain is a poor substitute for knowing what the document actually requires. Reading about law in the abstract does not fix this. What fixes it is working through the problem in the form it will actually take. This handbook is built for application. Every one of its sixteen chapters opens with learning objectives and a statement of what it assumes, develops the principle through numbered sections, and then tests that principle against two fully worked scenario analyses and a set of application problems. Reasoned model analyses for every problem appear in the back matter, written as analyses rather than answers, because in legal reasoning the route matters as much as the conclusion. What you will practise and apply;A structured method for any legal question: state the issue, identify the relationship and its source, locate the rule and its elements, apply it to the facts, separate what is established from what is assumed, and state a conclusion with its dependencies.Reconstructing when a contract was formed from a chain of correspondence, and resolving letters of intent, competing standard terms, and pre-contract work.Reconciling conflicting contract documents through order of precedence, and testing a limitation clause through each stage applied to it.Evaluating a delay claim where causes overlap, notice was imperfect, and a time bar is in play.Tracing a design failure through duty, breach, causation, remoteness, and the scope of the duty.Recognising the insurance gap that a fitness-for-purpose obligation opens, and how an amendment to a standard form can defeat its own purpose.Handling a claim that arrives many years after the work, a bond called, and a policy declined.Preparing evidence, maintaining a contemporaneous record, and understanding what is expected of an engineer acting as an expert.Key topics coveredLicensure and the right to practise. Professional ethics and the duty to the public. Contract formation and essential elements. Interpretation, terms, and the allocation of risk. Procurement, tendering, and bid law. Standard-form contracts and project delivery models. Contract administration and the engineer's dual role. Change, delay, disruption, and the anatomy of a claim. Negligence and the professional standard of care. Concurrent liability, economic loss, and third-party exposure. Limitation, indemnity, insurance, and security. Intellectual property in engineering practice. Employment, business organisation, and the consulting relationship. Regulatory compliance covering safety, environment, and product.
This handbook is built for application. Every one of its sixteen chapters opens with learning objectives and a statement of what it assumes, develops the principle through numbered sections, and then tests that principle against two fully worked scenario analyses and a set of application problems. What you will practise and apply;
- A structured method for any legal question: state the issue, identify the relationship and its source, locate the rule and its elements, apply it to the facts, separate what is established from what is assumed, and state a conclusion with its dependencies.
- Reconstructing when a contract was formed from a chain of correspondence, and resolving letters of intent, competing standard terms, and pre-contract work.
- Reconciling conflicting contract documents through order of precedence, and testing a limitation clause through each stage applied to it.
- Evaluating a delay claim where causes overlap, notice was imperfect, and a time bar is in play.
- Tracing a design failure through duty, breach, causation, remoteness, and the scope of the duty.
- Recognising the insurance gap that a fitness-for-purpose obligation opens, and how an amendment to a standard form can defeat its own purpose.
- Handling a claim that arrives many years after the work, a bond called, and a policy declined.
- Preparing evidence, maintaining a contemporaneous record, and understanding what is expected of an engineer acting as an expert.
