At the same time, in the data society, a substantial share of highly granular data is stored in the silos of private companies. This data covers central areas of public responsibility - such as mobility, health, the environment, energy, and disaster management. Due to economic incentive structures, companies retain it on a de facto exclusive basis. This gives rise to an asymmetric data landscape in which the state's informational and intervention capacities are structurally limited. Die Dissertation untersucht die rechtlichen Rahmenbedingungen staatlicher Datenzugangsrechte gegenüber privaten Unternehmen (Business-to-Government-Data-Sharing). Im Zentrum steht der grundrechtliche Schutz von Geschäftsgeheimnissen. Ausgangspunkt ist die Beobachtung, dass datenbasierte staatliche Entscheidungen eine wesentliche Voraussetzung rationaler Gemeinwohlpolitik sind. Zugleich liegt in der Datengesellschaft ein erheblicher Teil hochgranularer Daten in den Silos privater Unternehmen. Diese Daten betreffen zentrale Bereiche staatlicher Aufgabenerfüllung - etwa Mobilität, Gesundheit, Umwelt, Energie und Katastrophenschutz. Aufgrund ökonomischer Anreizstrukturen halten Unternehmen sie faktisch exklusiv. So entsteht eine asymmetrische Datenlandschaft, in der staatliche Informations- und Interventionsmöglichkeiten strukturell begrenzt sind. Nik Roeingh nimmt diesen Befund zum Anlass für eine dogmatische Analyse der Voraussetzungen, unter denen der Staat auf privatwirtschaftliche Daten zugreifen darf. Im Mittelpunkt steht das Spannungsverhältnis zwischen dem öffentlichen Interesse an evidenzbasierten Entscheidungen und staatlicher Innovationsförderung einerseits sowie dem grundrechtlichen Schutz wirtschaftlicher Freiheitsräume andererseits. Geschäftsgeheimnisse partizipieren am Schutz der Wirtschaftsgrundrechte; ein voraussetzungsloser staatlicher Zugriff ist daher ausgeschlossen. Vor diesem Hintergrund klärt der Autor grundlegende grundrechtliche und verwaltungsrechtliche Fragen staatlicher Datenzugangsrechte. Ergänzend werden ökonomische Ansätze herangezogen, um die Auswirkungen von Datenzugangsrechten auf Innovation, Wettbewerb und die Datenökonomie zu analysieren.
Die Dissertation analysiert bestehende und entstehende nationale und europäische Regulierungsansätze - insbesondere den Data Act - und entwickelt Kriterien für eine grundrechtskonforme Ausgestaltung staatlicher Datenzugangsrechte. Sie zeigt, wie sich das Spannungsverhältnis zwischen öffentlichem Datenzugangsinteresse und privatwirtschaftlichen Geheimhaltungsinteressen rechtlich austarieren lässt, und leistet damit einen Beitrag zur dogmatischen Einordnung des Business-to-Government-Data-Sharing im europäischen Digital- und Datenrecht.

If you are a consumer you can withdraw from the contract in accordance with the following. Consumer means any natural person who is acting for purposes which are outside his trade, business, craft or profession.

Statutory right to withdraw
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good or the last lot or piece.
To exercise the right of withdrawal, electronically fill in and submit a clear statement on our website, under "My Purchases" in "My Account". We will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to withdraw from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
