Family Court Appeals is the guide that tells you what that system actually is.
This is not a book that tells you what you want to hear. It will not promise that the appellate court will see through the other parent's dishonesty, reconsider the facts, or deliver the justice the trial court did not. Those are myths this book addresses directly, because believing them has led thousands of parents to invest years of effort and tens of thousands of dollars in appeals that were never going to succeed.
What this book does instead is give you the insider knowledge that courts and attorneys rarely explain clearly: the difference between a factual grievance and a legal argument, the standards of review that determine most appeal outcomes before a single argument is ever read, why the best interests of the child standard gives trial judges a degree of protection from reversal that makes family court one of the hardest areas in which to win an appeal, and what the specific, verifiable errors actually look like that cause appellate courts to reverse.
Inside you will find:
- The five threshold questions every family court appeal must answer before a brief is written.
- The specific legal errors that actually produce reversals in custody, visitation, child support, property division, spousal support, relocation, and domestic violence cases.
- Why emotional arguments do not just fail but actively damage the appeal.
- The constitutional parental rights framework from Troxel v. Granville and how it applies to third-party visitation, grandparent access, and fit parent cases.
- How courts handle due process violations including inadequate notice, denial of hearings, judicial bias, and inability to present evidence.
- The preservation requirements that silently destroy the majority of family court appeals before they begin.
- The complete standard of review landscape and why how an argument is framed is often more important than whether the argument is right.
- How to read a family court record the way an appellate attorney reads it, spotting the categories of error that courts actually correct.
- The twenty most common mistakes parents make on appeal, with the analytical depth to understand why each mistake fails.
- A custody checklist, support checklist, due process checklist, preservation review, and strength-scoring system designed to be used before a single brief is filed.
- And a final chapter from the perspective of the appellate judges who decide these cases, with the hard truths they wish every parent understood before walking into the appellate process.
If you are a parent, attorney, paralegal, law student, or family member navigating the family court appeal system, this book is written for you.
