The Digital Markets Act (DMA) complements competition law and limits the power of dominant digital groups. The EU Commission sets up a code of conduct for large digital companies. Central online platforms such as search engines, social networks or online intermediation services will then apply stricter rules in the future: For example, they will no longer be allowed to prefer their own offers in the ranking. Previously, only in Germany there were comparable regulations with the GWB Digitalisation Act, which came into force in 2021. The EU Digital Markets Act (DMA) will apply from May 2, 2023.
The Digital Services Act (DSA) will complement the now 20-year-old e-commerce policy and update parts of it. It provides for uniform horizontal rules on due diligence and disclaimers for intermediary services (such as online platforms) and is intended to contribute to a safe, predictable and trustworthy online environment and the smooth functioning of the EU internal market for intermediation services. This also includes the fact that the procedures for reporting and immediately removing illegal content will be made uniform throughout Europe in the future. In addition, additional care requirements for very large online platforms. The Digital Services Act applies in all EU states from 17 February 2024.
