Item description from seller

St. Paul, Minn.: Press of West Pub. Co., 1893. Horton, C.J. Decision of the Supreme court of the state of Kansas. The constitutionality of the House of representatives of the state of Kansas (known as the Douglass house) discussed and decided. The case of in re Gunn. Proceedings in habeas corpus. The written opinion of Chief Justice Horton, concurred in by Mr. Justice Johnston. Filed March 11, 1893. St. Paul, Minn.: Press of West Pub. Co., 1893. [471]-488 pp. Sewn wrappers. Moderately worn with foot of spine starting. Internally clean. $75. * This case centered on the "Legislative War of 1893," where two different groups claimed to be the rightful Kansas House of Representatives-one led by the Populist Party and the other by Republicans. A physical confrontation occurred in February 1893 when Republicans, led by Douglass, broke down the doors of the House chamber to claim control. The opinion written by Chief Justice Horton and Justice Johnston addressed the central question: which of the two rival groups was the legitimate legislature. The court ultimately sided with the Republican-led Douglass House. The decision resulted in Gunn being remanded to custody, effectively upholding the Douglass House as the constitutional body. The opinion discussed the fundamental issue of the legislature's constitutional validity and its power to enforce its authority.…
