Criminal law - Murder - Youth of 14 1/2 years convicted of murder - Circumstantial evidence - Whether proper trial - Reference to Supreme Court of Canada - Supreme Court Act, R.S.C. 1952, c. 259, s. 55. In 1959 Steven Truscott was found guilty by a jury of the rape and murder, at Goderich, Ontario of 12yr old Lynne Harper. Most of the evidence was circumstantial and Steven Truscott did not give evidence at his trial. Truscott was sentenced to death. The Canadian Prime Minister commuted the sentence to life imprisonment. The conviction was unanimously affirmed by the Court of Appeal, and an application for leave to appeal was refused in February 1960. Too young to be placed in an adult penitentiary, Steven went to the Ontario Training School for Boys. He was eventually released. 412pp. 8vo. softcover.
