The federal Bankruptcy Act of 1841, enacted in response to the Panic of 1837, was the first to permit voluntary bankruptcies. More than a generation had passed since enactment of the first Bankruptcy Act in 1800 and its repeal in 1803. The 1800 law had authorized creditors to place the debtor in bankruptcy and seize his assets; it had not allowed debtors to choose bankruptcy. The 1841 Act was grounded on Congress's power to establish "uniform laws on the subject of bankruptcies." Only two years after enactment, charges of corruption and profligate expenditures, and at least one lower court's decision that the Act was unconstitutional, led to its repeal. This pamphlet prints the provisions of the Act, supplemented with detailed explanatory notes, particularly on the Act's novel provisions for voluntary bankruptcies. Cohen 2466.
