Synopsis

Oklahoma, 1963. Delia Pruitt is seventeen years old, homeless, and carrying a four-month-old daughter she is determined to keep alive. When a neighbor offers to drive her to the store for diapers, Delia says yes. She does not know about the gun. She does not know about the plan. She is there to buy diapers.

A store employee is shot. A man is dead. Delia did not pull the trigger. Under the felony murder doctrine, it does not matter.

It Is Her is the second novella in the Avery Cross series literary legal fiction built on real cases from the American record. The case anchor is People v. Stamp, 1969, California. The rule is plain: if a death occurs during the commission of a felony, every participant is liable. Intent is not an element. Foreseeability is not an element. Presence is enough.
