How did the Supreme Court reach its decisions on abortion—and why did its reasoning change?
Pro-Life v. Pro-Death: Abortion and the Supreme Court brings together important portions of the Supreme Court's landmark abortion decisions, along with historical background and commentary to help readers understand the constitutional arguments behind them.
This second edition expands the original book to include the Supreme Court's landmark decision in Dobbs v. Jackson Women's Health Organization, the case in which the Court overruled Roe v. Wade and Planned Parenthood v. Casey.
The book examines:
• Roe v. Wade: The Court's original constitutional reasoning concerning abortion
• Doe v. Bolton: The Court's companion ruling to Roe
• Planned Parenthood v. Casey: The Court's reconsideration of Roe and its revised approach to abortion regulation
• Dobbs v. Jackson Women's Health Organization: The Court's reasoning for overruling Roe and Casey
But this is not simply a collection of case summaries. The book includes substantial portions of majority opinions, concurring opinions, and dissenting opinions, allowing readers to encounter the arguments in the justices' own words.
The book also includes an appendix containing the First, Fourth, Fifth, Ninth, and Fourteenth Amendments, which are frequently discussed in these opinions.
A second appendix features eight additional Supreme Court abortion cases. Each of these was repeatedly quoted or relied upon in one or more of the four landmark decisions examined in this book. Seven of the eight also appear in the excerpts the author chose. The eighth, Gonzales v. Carhart, is included because of its importance in the development of the Court's abortion jurisprudence and because it was a major Supreme Court abortion decision preceding Dobbs.
Written from a conservative, pro-life perspective, this book is intended for readers who want to look beyond political talking points and examine the Supreme Court's reasoning for themselves.
Whether you are already familiar with these cases or are encountering them for the first time, Pro-Life v. Pro-Death provides an opportunity to explore one of the most consequential constitutional controversies in American history—through the words of the justices who decided these cases.
