Synopsis

As part of the EncroChat operation, French law enforcement agencies collected millions of messages from over 60,000 Encro-chat users by infiltrating the chat service commonly used by criminals. Throughout Europe, this data is used in thousands of criminal proceedings for drug offences. Defendants, on the other hand, defend themselves on the grounds that the right to a fair trial, an effective remedy and privacy are violated. On the 6th Hamburg Security Law Day on 8 November 2023 with the title "Policing Crime Chat Networks – Lessons from the Encrochat Operation", experts from the police, justice and science first addressed the experiences with the encrochat operation. Then, experts from the fields of IT, criminology and law discussed the technical and legal implications of the EncroChat operation and future chat controls to fight crime with an interdisciplinary perspective. Opportunities for law enforcement, but also the risks to the fundamental rights of those affected and challenges to regulation were considered here. What experience have LKA Hamburg, justice and criminal defence gained with EncroChat proceedings? What is the perspective of law and computer science here? What methods, opportunities, and risks of chat controls exist and what are the constitutional implications here? What legal frameworks for digital evidence in the criminal proceedings are to be considered? The conference was organised by the Research Centre European and German Security Law (FEDS) of the University of the Academy of Police Hamburg with the participation of representatives of the LKA Hamburg, the Institute of Criminal Sciences and the Centre for Digitisation and Law in Research and Teaching (CAU Kiel).
