Synopsis

In 1991 Congress enacted the US Federal Sentencing Guidelines for Corporations. These Guidelines essentially required US companies to establish compliance programs for their employees. In response, corporations began to establish compliance programs. Indeed, as of this writing every public US corporation has a compliance program. Further, an entirely new profession – compliance officer – and a new industry came into existence. A new professional association was created – the Ethics and Compliance Officers Association.
But Judaism – being a legal system – already has had a “compliance program” in place for thousands of years! That program is contained within the Torah and halakha (Jewish law), which directs how life should be lived in all its aspects, including the ethical and legal standards regarding how business should be conducted. This book synthesizes the theoretical and practical aspects of Jewish law and tradition with the everyday demands of the workplace in order to create a code of conduct for business that complies with both United States law and Judaism.
Heavily annotated and drawing extensively on traditional rabbinic sources and current United States law, the code of conduct this book recommends is firmly rooted in Jewish tradition, while at the same time meeting the needs of the modern business (and non-profit) enterprise. It is organized such that any organization that institutes the Code can be confident that compliance with it will meet the exacting demands of Jewish tradition and, also, satisfy applicable legal requirements.
The book evidences the author’s deep knowledge of both modern compliance standards and programs on the one hand and the Torah, Talmud, and other rabbinic sources on the other – which allows him to deal with modern compliance in an advanced, nuanced way. It considers the approach of the Jewish tradition to the concepts of labor, economic activity, wealth accumulation, and fairness in business conduct. The author advocates for organizations applying the wisdom of Jewish tradition to how they conduct their affairs, which will create an ethical, more just, and legally compliant business environment.
