Synopsis

Civil Litigation is a thorough, up to date and practical introduction to the Civil Procedure Rules and the principles and tactics used in pursuing a civil case. The civil process has been divided into five stages, starting with pre-action considerations, moving on to examine the issue and service of proceedings, before considering interim matters, trial and enforcement. The aim of the book is to equip readers with the necessary knowledge to enable them successfully to navigate their way through these stages. The text has a user-friendly structure and includes checklists and specimen documents which build up into a case study forming a useful overview of the civil litigation process. The appendices incorporate helpful templates, flow diagrams, case study documents and copies of the more common court forms used in civil litigation. This new edition has been revised to include additional templates for drafting key documents in Appendix B (Defence, Defence and Counterclaim, Directions Order, List of Documents and Expert's Report), a new flow diagram in Appendix C (notice requirements for a CFA and AEI) and a new fast track personal injury case study in Appendix E. All references to professional conduct issues now incorporate the Solicitors Regulation Authority's new Code of Conduct, 2011. Also included are details of electronic disclosure under the new Practice Direction 31B; practical tips on dealing with inspection; examples of when a hearsay notice is required; and how to address the issue of costs in a consent order Recent case law developments have also been added, including Bayat Telephone Systems International Inc v Cecil (2011) (service of claim form); Oceanbulk Shipping & Trading SA v TMT Asia Ltd (2010) (without prejudice); Tel-Ka Talk Ltd v Revenue & Customs Commissioners (2011) (contingency fee); Inventors Friend Ltd v Leathes Prior (a firm) (2011) (fixed fee); Bell v London Borough of Havering (2010) (evidence); Gibbon v Manchester City Council (2010) (Part 36); LG Blower Specialist Bricklayer Ltd v Reeves (2010) (Part 36); and Rolf v De Guerin (2011) (costs).
