Data Protection Litigation in the UK is a practical guide to the fast evolving field of data protection litigation.
Data protection litigation is brought by people claiming compensation or other remedies when their personal data has been mishandled. It is on the rise for several reasons such as:
- People becoming more aware of their legal rights
- Technology (such as AI) processing more data than ever before
- Large-scale data breaches becoming increasingly common
Such litigation can arise in many scenarios including where companies:
- Suffer a cyber-attack and lose customer data
- Fail to uphold data rights such as preventing a person from accessing their data
- Use data behind people’s backs without their knowledge
This book provides a clear and structured overview of the main types of litigation arising under UK data protection law and considers key areas including:
- A refresher on the UK Data Protection regime
- An examination of the different types of data claims including data breach claims, data rights claims and cookie litigation
- Group data litigation
- The level of damages awarded in UK courts
- Costs in data claims
Each chapter examines key legal issues and important case law as well as common pitfalls and misconceptions in data protection litigation. The book includes practical tips for litigators, in-house counsel, and compliance professionals.
Whether you are advising clients, managing risk, or responding to claims, this book is an invaluable resource.
