Die Wissenschaft befaßt sich nur mit Wirklichkeiten. Im Gegensatz zu den Wissenschaften steht daher die Moral, die sich mit Schätzungen der Wirklichkeiten befaßt und die Politik, welche sich die Ausführung der Schätzbarkeiten zur Aufgabe setzt. Insoweit sich also die Lehre vom Recht mit der Moral und Politik in ungetrennter Verbindung befindet, ist die jurisprudenz keine Wissenschaft. In der Tat muß man sagen, daß die ]urisprudenz bis heute diese Verbindung nicht loswerden konnte. Dieses Schicksal haben alle Wissenschaften durchgemacht. Die Naturwissenschaften, die Mathematik des Pythagoras, die Chemie des Paracelsus, die Nationalökonomie bis auf die heutige Zeit waren mit Elementen der Moral, der Ästhetik, der Politik, mit dem Glauben, mit der Schätzung und der Wünschbarkeit durchwoben und durchsetzt. Die ]urisprudenz, die von Ideen spricht, die sich in der Ent wicklung durchsetzen, die ein N aturrecht zu formulieren sucht, ist genau so Moral und Politik anstatt Wissenschaft, wie es auch die Iurisprudenz ist, die von einem Prinzip von Treue und Glauben, von Verkehrsschutz, vom Vertrauen auf äußere Tatbestände spricht.
