Se hace preceder a los seis libros, un título preliminar que establece sucintamente lo que es comercio, quiénes pueden ser comerciantes, y que parte del Código constituye las bases ge nerales de la Legislacion mercantil a que se refiere la fraccion 109 del artículo 72 de la Constitucion Federal. Se fijan como bases, las relativas a comerciantes, agentes mercantiles y ma tricula, porque en una Nacion iguales deben ser las oualida des personales que reconozca el derecho. El interes general del comercio exige igualmente que sean comunes las reglas sobre contabilidad y correspondencia. Siendo un interes gene ral lo que se refiere a ferrocarriles, telégrafos y letras de cam bio, debia comprenderse en las mismas bases. Lo relativo contratos estipulados en país extranjero y quiebras, es por su naturaleza general a toda la nacion: asi como el derecho mao ritimo por su esencia misma, tiene que aplicarse a los puer tos, costas, islas y aguas territoriales de la República en am bos mares.
