According to the author, statutes enacted to protect a wife's separate property in the case of divorce or abandonment, do not extend to contracts entered into between spouses. The author argues that while the wife cannot bind herself to a contract with her husband, if her husband takes possession of her property, he becomes a trustee for her and is accountable for any proceeds. The author examines case law on the topic and concludes that the presumption of law is that any property acquired by the wife by descent, devise or gift remains her separate property. The author argues that this presumption can only be overcome by evidence sufficient to prove that the wife intended to make a gift of the property to her husband.
