Sagt Jemand, jener mein Erstgeborner soll den doppelten Antheil nicht nehmen; jener mein Sohn soll mit seinen Brü dern nieht erben, so hat er nichts gesagt, denn er hat gegen das, was in der Thom steht, eine Bestimmung getroffen. Vertheilt Jemand seine Güter mündlich Todes halber als Geschenk und bestimmt dem Einen viel, dem Andern wenig, oder er stellt den Erstgeborenen mit ihnen gleich, dann haben seine Worte Geitmrg; spricht er dieses aber als Erhschaf t au's, so hat er nichts gesagt. Schreibt er aber sei am Anfange, sei in der Mitte, sei am Ende „als Geschenk, dann haben seine Worte Geltung.
