Questo istituto in un maggiore sviluppo del diritto sociale, ed a misura che l'umanità progredisce e s' avvia a quello che è l'i deale della giustizia la solidarietà umana avrà il suo massimo svolgimento. Esso potrà essere in avvenire anche tramutato in un istituto imposto, e cioè quando nelle contrattazioni interviene la società., per mezzo dello Stato, supremo moderatore dei varii inte ressi, e con la sua autorità ed in nome dei diritti comuni, a pro teggere idebdli e gli umili, impone la transazione ai forti ed ai po tenti. Certo nelle presenti condizioni sociali esempii di transazioni imposte non ne mancano, come nel fallimento il concordato fra il debitore ed i creditori, nei rapporti dei consumatori e produttori il prezzo limitato nelle pubbliche necessità, nei rapporti degli operai coi padroni la tarifl°a determinata della mano d' Opera e la limi tazione delle ore di lavoro.
