Darum also handelt es sich für die Rechtsordnung, das mafsgebende Kriterium für die Entscheidung der Frage zu finden, welche Bestrebungen nach Gütervermehrung in ihrem Bestände sicherzustellen, welche davon hintanzuhalten oder in ihrer Wirkung wieder aufzuheben sind. Nun ist Güter vermehrung nichts anderes, als was die gemeine Anschauung unter dem Namen der Bereicherung begreift. Die Frage ist demnach dieselbe, die in der Regel in der Gegenüberstellung der rechtlich zulässigen und der rechtlich unzulässigen oder ungerechtfertigten Bereicherung zum Ausdruck ge bracht wird.
