Dans les arr�ts de rejet, la Cour de cassation peut approuver le dispositif d'un arr�t de la Cour royale par des raisons non semblables ou m�me oppos�es � celles qui ont d�tourn� cette derni�re. -il en r� sulte que 'les deux arr�ts, bien qu'identiques'comme decisions de proc�s, sont cependant diff�rents ou oppos�s comme point de doctrine voy. Par exemple un arr�t de cassation, sect. Des req. 10 ao�t 1809, qui d�cidant une question d'apr�s les principes de l'ancien droit, qu'elle d�clare seuls applicables � la cause, rejette le pourvoi contre un arr�t de la Cour de Rennes du 2 1 mars 1808 qui avait appuy� son dispositif sur les principes de la l�gislation nouvelle.
