Le premier 'cas où un justieiable peut encourir l'amende pour infraction aux lois de la procédure civile, est celui où il ne com paraît point au bureau de paix avant d'intenter ou de repousser l'action qui lui compète ou qu'on dirige contre lui. Mais il faut observer que l'amende n'est pas encourue de plein droit. On ne pourrait l'exiger si la demande n'était point portée au tribunal ci vil. Cc point est formellement tranché par une décision du mi nistre de la justice qui porte en même temps que la partie qui n'a point comparu en conciliation doit être condamnée à l'a mende, et par défaut, si elle ne se présente pas devant ce tribu nal il résulte de 121 que le'demandeur (quoiqu'on' le pratique dans quelques tribunaux) n'est point tel... de consigner l'a mende d'avance, aux lieu et place du défendeur défaillant. Il 11'y a lieu de la réclamer que contre celui-ci, et lorsque le tri bunal de première instance l'aura condamné à la payer. Cette condamnation sera le seul résultat de sa non-comparution au bureau de paix; car il serait inju'ste que par son absence il pût paralyser l'action du demandeur.
