In the shadowed corridors of civil litigation, the capias pro fine had long been a tool ripe for exploitation, used less for order than for opportunism. This Act struck a decisive blow against the murky custom of levying arbitrary fines on defendants post-judgment. Instead of perpetuating fees that vanished into the coffers of court officers, it established a clear and modest cost, six shillings and eightpence, payable by the victor and recoverable within costs.
