Un condamné à mort raconte sa condamnation, son séjour à Bicêtre, puis à la Conciergerie, décrit les préparatifs de son exécution, sa dernière toilette, le voyage en charrette vers l'échafaud, ses impressions durant les quelques instants de délai qui lui sont accordés, mais qui vont bientôt s’achever. Le spectacle du départ des forçats, les noms des condamnés qui l'ont précédé dans sa cellule, la complainte qu'il entend chanter en argot, sa conversation avec le stupide greffier, avec le prêtre, avec les geôliers, avec sa petite fille, tels sont les derniers objets qui occupent sa pensée. Ses angoisses, son horreur devant l'idée de la mort font de cette « agonie de trois cents pages » une œuvre d'une « atroce et horrible vérité » (J. Janin). L'auteur avait choisi ce sujet pour sa valeur dramatique. Dans sa Préface de 1832, Victor Hugo insiste surtout sur sa portée sociale comme attaque contre la peine de mort. La quatrième édition contient une sorte de préface en dialogue : Une comédie à propos d'une tragédie, dans laquelle l'auteur défend son œuvre contre les critiques.
