In Ãsterreich liegen derzeit zwei Entwürfe zur Reform der schadensersatzrechtlichen Vorschriften des seit dem Jahre 1811 bestehenden Allgemeinen Bürgerlichen Gesetzbuchs (ABGB) vor. Der erste Entwurf, nachfolgend durchgängig als "Entwurf" bezeichnet, wurde im Juni 2005, der als Reaktion darauf erarbeitete Gegenvorschlag, nachfolgend als "Gegenentwurf" bezeichnet, im Januar 2008 vorgestellt. Beide Entwürfe regeln das gesamte Schadensersatzrecht; das heiÃt sie beinhalten alle anspruchsbegründenden (Ansprüche auf Schadensersatz aus Vertrag und aus Delikt) und haftungsausfüllenden Normen (entspricht §§ 249 ff. BGB) des Schadensersatzrechts. Diese einheitliche Regelung entspricht der Systematik des ABGB, welches die Haftung aus Vertrag und aus Delikt innerhalb eines Kapitels behandelt. Zur Begrenzung des Umfangs konzentriert sich der Autor dagegen auf die Untersuchung der anspruchsbegründenden Normen des Deliktsrechts und der dazugehà rigen haftungsausfüllenden Normen. Die Regeln beider Entwürfe sollen mit dem Ziel verglichen werden, den jeweils überzeugendsten Vorschlag für eine Reform des ABGB herauszuarbeiten. Darüberhinaus wird untersucht, inwiefern auch eine entsprechende Reform der Parallelnormen des BGB anzuraten ist. Mitberücksichtigt wird bei dieser Untersuchung der europäische Trend. Zur Herausarbeitung eines solchen mà glichen europäischen Trends werden die "Principles of European Tort Law" (PETL) und die Tort Law Principles der Study Group on a European Civil Code (DCFR) herangezogen. Beide Principles sind keine Gesetze im eigentlichen Sinne, da sie keinerlei Rechtskraft entfalten. Sie bieten lediglich wie auch die beiden à sterreichischen Entwürfe eine Diskussionsgrundlage. Aber sie sind beide das Ergebnis des Zusammenwirkens internationaler Kommissionen, die mit dem Ziel, einen Gesetzesvorschlag für ein mà gliches gemeinschaftliches Deliktsrecht zu erarbeiten, die verschiedenen deliktsrechtlichen Regelungen in und auÃerhalb Europas miteinander verglichen und versucht haben, den gemeinsamen Nenner herauszufiltern und in einen Gesetzestext zu formen. Die Principles sind also das in Gesetzestext gefasste Resultat europäischer Rechtsvergleichung und daher in besonderem MaÃe für die Herausarbeitung eines europäischen Trends geeignet. Die PETL stammen aus der Feder einer Kommission, die 1992 zunächst als "Tilburg Group" unter der Leitung von Spier begann und nunmehr mit Spier und Koziol als Leiter eine Vereinigung von 20 Mitgliedern aus verschiedenen europäischen Staaten, aus den USA, Israel und Süd-Afrika bildet und in Wien ihren Sitz hat. Sie verà ffentlichte das Resultat ihrer Arbeit samt Kommentierung der einzelnen Vorschriften schon ein Jahr vor der Publikation des à sterreichischen Entwurfs im Jahre 2004. Die "Study Group on a European Civil Code" mit Sitz in Osnabrück wurde dagegen 1999 von Christian von Bar ins Leben gerufen. Ihr Ziel ist es, einen mà glichen Gesetzesvorschlag für ein gemeinschaftliches Zivilrecht zu erarbeiten, den sogenannten Draft Common Frame of Reference (DCFR). Hierfür bildete die Study Group verschiedene Sektionen ("Working Teams"), die die jeweiligen Teile des Gesamtwerks eigenständig erarbeiteten. Im Internet ist die Endversion ihres Vorschlags für ein gemeinschaftliches Deliktsrecht (Non-Contractual Liability Arising out of Damage Caused to Another) von November 2006 abrufbar.
