Denn nach Art. 24 der Konvention müssen die Vertragsstaaten sicherstellen, dass Menschen mit Behinderungen Zugang zu einem inklusiven, hochwertigen und unentgeltlichen Unterricht an Grundschulen und weiterführenden Schulen haben.Kernargumentation des Diskurses ist, dass die Förderschule nicht zur Integration der von einer Behinderung betroffenen Subjekte beiträgt. Dies steht mit der wissenschaftlichen Forschung im Einklang, durch die nachgewiesen werden kann, dass in der Förderschule als Teil des Bildungssystems direkte und indirekte institutionelle Diskriminierung an der Schülerschaft verübt wird.Dabei wird die Selektion von Subjekten auf Förderschulen durch die Heilpädagogik dadurch legitimiert, dass diese eine eingeschränkte Autonomie aufweisen und davon abgeleitet eine natürlich bedingte negativ abweichende Lern- und Leistungsfähigkeit. Ein solches Menschenbild mit einem entsprechendem biologisch begründeten Begabungs- und Intelligenzkonzept mit Höher- und Minderwertigkeitsvorstellungen, erlaubt eine Hierarchiebildung, die dem gesamten deutschen klassenspezifischen, monistisch dominierten Bildungssystem zugrunde liegt. Unter dieser Denkweise können alle Subjekte über konstruierte Differenzen ihren Ort zugewiesen bekommen.Über die Differenzkategorie Körper hinaus wird über weitere konstruierte Differenzkategorien, mit denen Minderwertigkeitsvorstellungen verknüpft sind, selektiert.
