Christoph-David Munding beschäftigt sich mit den rechtsdogmatischen Hintergründen der Rechtsschutzgarantie in der EU und geht der Frage nach, ob das Individualrechtsschutzsystem der EU den Anforderungen dieser Garantie gerecht wird.Dazu beleuchtet der Autor zunächst die Rechtsnatur der EU-Grundrechte und qualifiziert das Recht auf effektiven Rechtsschutz als eigenständiges Grundrecht innerhalb dieses Grundrechtsregimes. In der Folge wendet sich der Verfasser der allgemeinen Grundrechtsquellenhermeneutik der EU zu. Die Einbettung der Charta der Grundrechte in die prätorisch geprägte Grundrechtsquellensystematik wird dabei in einem dritten Schritt besonders thematisiert. Munding widmet sich anschließend der Frage nach der Effektivität des Individualrechtsschutzsystems und untersucht hierbei vor allem die Möglichkeiten des Einzelnen, normative EU-Rechtsakte anzugreifen. Er kommt zu dem Ergebnis, dass das Individualrechtsschutzsystem in seiner durch den EuGH geprägten Gestalt der Rechtsschutzgarantie nicht vollends gerecht wird. Daher untersucht er mögliche Wege der Verbesserung im zentralen sowie dezentralen Rechtsschutzzweig. Im Ergebnis empfiehlt der Autor de lege lata eine Neuauslegung der Klagebefugnis der Nichtigkeitsklage sowie de lege ferenda die Änderung der Anforderungen an die Individualklagebefugnis verbunden mit der Einführung eines vorausgehenden Klageannahmeverfahrens.Ausgezeichnet mit dem Wolf-Rüdiger-Bub-Preis 2008.
