La spécificité de l'institution devrait tout d'abord conduire à la création d'une catégorie de rattachement autonome aux contours suffisamment larges pour accueillir les deux grands modèles de partenariats, les partenariats institutions et les partenariats contrats, et suffisamment restreints pour exclure les unions de fait et les mariages homosexuels.A cette nouvelle catégorie sera associé un rattachement à la loi de l'Etat dont dépendent les autorités qui ont procédé à l'enregistrement afin d'éviter la désignation d'une loi qui ignore l'institution et de garantir la cohérence du statut des partenaires. Cette règle de conflit définie, il conviendra ensuite de déterminer si les partenariats étrangers qui produisent des effets plus importants que le PACS seront susceptibles d'être reconnus en France.L'ordre public et les difficultés de coordination pourraient en effet s'opposer à leur réception dans l'ordre juridique français.
