"This document contains the report of the Virginia legislature, authored by Madison, defending the Virginia Resolutions of 1798. Madison discussed each resolution in detail, elaborating further the position that.the states, as creators of the federal compact, retained the right to declare when it had been violated" [Sheidley]. That position, the most significant advocacy of State Rights in American constitutional history, became, in the hands of John C. Calhoun and other southerners, the theoretical basis for secession. The Report reminds critics that the national government is one of explicitly delegated powers, "that the powers not given to the government were withheld from it." Because the Constitution was formed "by the sanction of the states, given by each in its sovereign capacity.there can be no tribunal above their authority, to decide in the last resort, whether the compact made by them be violated; and consequently that as the parties to it, they must themselves decide in the last resort, such questions as may be of sufficient magnitude to require their interposition." It is the duty of the States to interpose their authority for the purpose of "maintaining the authorities, rights and liberties, appertaining to the states as parties to the constitution."
