International Maintenance Law for cases with foreign connections is very important due to the large number of foreign fellow-citizens living in Germany. This volume updates the legal position. In particular it traces the amendments in Turkish maintenance law. It also follows the developments in domestic and foreign maintenance agreements from The Hague. One highlight in the detail is for example in the question of whether for post-marital maintenance a choice of legal system is possible. International Maintenance Procedural Law is explained in detail in Appendix III to Article 18, in which the user is securely guided through the confusing situation of different legal sources. In the foreground there is a detailed commentary on the two Maintenance Enforcement Agreements from The Hague, the UN Agreement for the enforcement of maintenance claims abroad and the appropriate standards of European Civil Proceedings Law. The preliminary remarks to Article 19 are devoted to the International Children's Law Agreement and to EC-Regulations. In the preliminary remarks "A" the order of precedence of the legal sources and the interpretation principles are presented. Preliminary Remarks "B" describe all the details (also from a legally comparative point of view) of the important Hague Minor Protection Agreement passed in 1961. This is the most thorough commentary of this agreement in the German-speaking countries which in the revised edition also considers the fundamental amendments due to the reform of the children's law.

Synopsis:
The volume comments on the legal matrimonial conditions of the new decree (EC) No. 2201/2203 concerning the responsibility and the recognition of decisions in matrimonial matters and in procedures concerning parental responsibility (EheGVO) (matrimonial and parent and child cases) dated 27.11.2003, which comes into force on 1.8.2004 and is to be fully applied by 1.3.2005 and the current version if there is a deviation. The second section comments on authoritative German Law in relationship to third countries including Denmark regarding international jurisdiction and the recognition of foreign decisions in matrimonial matters ( 606a, 328 Code of Civil Procedure; Art 7, 1 German Act Amending the Family Law). Both sections consider the procedural execution questions which are regulated in the EheGVO
