Excerpt from Calendar of Wills: On File and Recorded in the Offices of the Clerk of the Court of Appeals, of the County Clerk at Albany, and of the Secretary of State, 1626-1836 The manner in which the intentions of deceased persons, expressed in their last wills, are carried out, or rather in which these intentions are legalized, is sui generis in the State of New York, which as a Colony was first governed under Roman-Dutch law, and it seems appropriate that a volume which gives abstracts of wills, made in Colonial days, as well as after the organization of the State, should have a history of the legal proceedings to which last wills were and are subjected as Introduction. According to "The Roman Law of Testaments, Codicils," etc., by Moses A. Dropsie, the form, "last will and testament," almost universally used, and the term "will" for "testament," are incorrect, because the Roman Law, from which testamentary disposition of property was embodied into the common law, only knew the term testamentum, and never employed the words ultima voluntas or voluntas.
