Excerpt from Report on the Trial by Jury in Questions of Personal Freedom, 1837
Aside from the interesting and delicate questions thus presented by the petitions, the Committee would bet have hesitated in reporting a bill in conformity with the object of the order. They believe the furnishing of such a rem edy as is made the subject of this inquiry, to be a meas ure,without reference to its effect upon those claimed as fugitives from labor, if not of constitutional obligation, at least of the highest political wisdom, and necessary to the completeness and perfection of our system. It would be useless here to discuss the merits of the trial by jury. It 1s justly dear not only to the citizens of Massachusetts, but to the whole American people, who have always guarded it with a solicitude, which is the best evidence 'of their estimate of its worth. Our fathers brought it with them from England, as one of the free elements of her institutlons - Lone, which had been the safeguard of all the rest, and the renewed security of which the people there ever first demanded in every one of those concessions1837.
