What is noticeable here, in addition to the assertion of the Crown's right to a royalty on the output, is the limitation of the claim possessed by the (beneficial) owner of the soil to the owner ship oi the minerals. The necessity must have been early felt of regulating the conditions under which mines should be worked by others than the occupants of the surface. And by this regulation, they became the property of the worker, subject to the payment of a fixed part of the produce to the owner of the soil, and a similar payment to the Crown.
