Cases and Commentary On Tort - Softcover

9780273631583: Cases and Commentary On Tort

Synopsis

This book provides a mainstream selection of cases on tort, together with statutes, linked by commentary. Each chapter is prefaced by a highly readable introduction alerting the reader to the salient features of the topic under discussion. The text has been designed to be accessible to student readers, and the extracts are of a length that aims to be both manageable and informative. The commentary places the extracts in context, points to other cases for contrast and comparison, and contains, where appropriate, extracts from other relevant authorities. In the light of the increasing influence of EC legislation, particular emphasis is given to those areas which demonstrate this influence, e.g. breach of statutory duty and product liability.
The book is intended to be used to provide a reference to key sources to which students cannot always be guaranteed access.

From the Back Cover

Cases and Commentary on Tort 4e
Cases and Commentary on Tort brings together a selection of cases both old and new, linked by commentary and cross-references, that illustrate the basic principles of tort. It is best used as a companion to a suitable textbook on tort, and provides a portable reference to key sources. The increasing availability of a vast range of easily accessible electronic sources of both case and statute law may sometimes prove confusing, and this book provides a firm platform from which to explore both paper and electronic sources.
This fourth edition includes the expected crop of new cases in a number of areas. The principal areas of development are- the operation of policy in relation to the existence of a duty of care in negligence - a field in which human rights law is increasingly relevant; negligently induced psychiatric damage; private nuisance; and defamation - also an area increasingly influenced by human rights issues. Some of the new cases are useful in illustrating basic principles, while others develop or extend such principles.
The book is designed for ease of use by students and is aimed at those taking LLB, combined law degrees, Diploma and CPE, ILEX and External LLB courses.
Barbara Harvey, LLB, LLM, is a Senior Lecturer and John Marston, LLB, Solicitor, is a Principal Lecturer, at the School of Law, De Montfort University, Leicester and is a Part-Time Chairman in the Appeals Service.
