Debbo la prima ispirazione di questo mio scritto ad un auto revole suggerimento di Pietro Bonfante. L' insigne Romanista dell'università di Pavia, per me interpellato, mi fece l'onore di proporre come oggetto delle mie prime indagini un argomento, che aveva offerto assai interessante materia di studio alle sue esercitazioni giovanili l' a it to r i t d d e i tribuni della plebe nel diritto privato.
Egli richiamava la mia attenzione sull' opuscolo assai note vole, pubblicato intorno a questo complesso e singolare problema da augusto eigenbrodt, col titolo De Magistratuum Romanorum iuribus quibus pro pari et pro maiore potestate inter se utebantur, imprimis de tribunorum potestate. Quaestio de iure publico. Lipsiae, Hinrichs, 1875, pagg. 158. Ed avvertiva, essere esauriente a suo giudizio la trattazione dal punto di vista del diritto pubblico, anzi tale da meritar considerazione, sopra di questo particolare subbietto, a preferenza della trattazione stessa riassuntiva che vi aveva con sacrato il mommsen, nel suo Abriss des Ṛmischen Staats rechts 2. Leipzig, 1907, pagg. 123 - 127. Ma aggiungeva, che la tesi gli sembrava difettosa sotto il punto di vista del dir itto p ri vato, e che egli la giudicava degna di esser ripresa inattento esame, anche alfine di mettere in giusta luce i risultati definitivi raggiunti dall' E i ge n br o dt, e che non avevano per anco trovato nella scienza l'accoglimento e il favore a cui avevano diritto.
