This unique work analyzes the Dharmasastra, India's ancient legal literature, as a source of dharma. Ariel Glucklich takes a radically new look at several myths and rituals used in legal contexts by the authors of the Sanskrit literature known also as smrti, the large body of writings that attempted to teach the rules of a righteous life. He focuses on the text that provides the clearest and most comprehensive descriptions of the classical legal system of India~the Manu Smrti. A thoroughly phenomenological approach to the study of dharma, this book employs a number of innovative approaches designed to avoid both legal and sociological reductionism; it also fills a major gap in the literature by systematically developing Hindu religious themes and ideas and demonstrating the centrality of religion in the formulation of dharma. Glucklich examines the Manu Smrti as a comprehensive religious textand as a conscious integration of legal material within a Vedic world view. This book explores a number of topics not usually examined in such depth. Glucklich clarifies the religious aspect of the king's judicial role; the ritual significance of the trial and its relation to Vedic sacrifice; and the spiritual efficacy of criminal punishment. Throughout, he stresses the Brahmanical sacrifice as an organizing principle in the formation of Indian religious jurisprudence. Here are fresh, revealing analyses of the cultural milieu of the authors of the Manu Smrti; a sociological~conceptual analysis of karma; a mythological exegesis; a discussion of the ritual of justice and punishment; a study of the application of Vedic hermeneutics (Mimamsa] to the sphere of Dharmasastra law; and reflections on the relationship of religion to law in general. Religious Jurisprudence in the Dharmasastra is a seminal attempt to bridge the gap between legal historians who are familiar with, but do not fully explicate, the religious character of Dharmasdstra, and scholars of religion who view it merely as a body of legal texts. Historians of religion, historians and scholars of India, comparative sociologists, and cultural anthropologists will find this to be a source of stimulating new approaches to Indian religion, law, and social life.
