[From jacket flaps] BENEFIT OF CLERGY IN AMERICA has little to do with clergymen and nothing at all with any advantages that may have been derived from the presence of divines in colonial America. Rather, it deals with that curious judicial doctrine whereby one who could demonstrate an ability to read, and thereby establish the fact that he was a clergyman, could escape the death penalty at least once for any of certain capital crimes that he had committed. This English doctrine, which had its origin in the ecclesiastical courts, crossed the seas as something of a stowaway in the cargo of judicial lumber and became domesticated in every jurisdiction in colonial America, save one. It had a bearing - on many of the famous trials of the colonial period, including those of Captain Thomas Smith, who was involved in Claiborne's Rebellion, of the Long Finn, of the British soldiers who participated in the Boston Massacre, and, at least indirectly, of Stede Bonnet, the pirate. Though often modified in form, it persisted in many jurisdictions until after the Revolution and in one was not finally abolished until 1869! Benefit of clergy has long since passed into desuetude. This book, therefore, will not assist any lawyer in winning a case before any tribunal, high or low, nor will it supply more than a modicum of lecture Continued from front flap notes for the hard-pressed professor of history. It is intended, as Mr. Dalzell says in his Preface, for "slippered readers rather than academicians." For such readers it will provide an amusing account of the English system of dealing with felons and of the transportation of that system to this country, its domestication here, and its development in America, all strung together on the somewhat tenuous thread of benefit of clergy.
