A Defense of Critical Pragmatism
I present a critical survey of the major philosophical approaches to law and judicial decisionmaking: Natural Law, Legal Positivism, Ronald Dworkin, Law & Economics, Interpretivism, Marxism, Critical Legal Studies, and Feminism. I then advance and defend Critical Pragmatism, which contends that law is rationally justified, while incorporating some insights from leftist critiques.
