Ser conforme al derecho significa algo más y algo diverso del existir o poder físicamente existir; el criterio jurídico es un criterio preexistente. La función especial del Derecho se ejercita separando acciones posibles de otras que también lo son; el simple hecho, o bien la posibilidad de orden físico, por ser común a los términos de la antítesis, no constituye un elemento distintivo o diferencial, sobre el cual pueda fundarse una proposición jurídica cualquiera. Para que se realice un juicio sobre el derecho debe darse un principio de orden racional, no de adecuación, sino de graduación de los hechos. Si realmente se ha realizado determinada acción, esto solo prueba que era físicamente posible, pero deja completamente intacta la cuestión acerca del derecho, acerca de la posibilidad jurídica de la misma acción. Al decir que el hecho está lógicamente subordinado al derecho, aspiramos precisamente a significar que el juicio sobre el derecho, por su naturaleza, es valuativo, sintético y no analítico, respecto al conocimiento empírico de la realidad. La verdad del Derecho no depende, por tanto, de su aplicación, de su confirmación en el orden de los fenómenos. El derecho subsiste lógicamente aun allí donde es violado, y más bien adquiere mayor relieve, en su propia naturaleza ideal, cuando a él se contrapone, sin llegar a destruirlo o rebajarlo, el hecho físico de la violencia.
