About this Item
The first set of Supreme Court reports from New York state, with cases beginning in 1794, when the court was known as the Supreme Court of Judicature. The oldest state Supreme Court with general original jurisdiction is the New York Supreme Court, which was established in 1691 by the Colony of New York, as the Supreme Court of Judicature. That court was continued by the State of New York, when independence was achieved in 1775. This volume includes New York state law as it developed following the Revolutionary War, in the time before Albany had been declared the permanent state capital. Includes a list of "Names of the Cases Reported", and Index. The author acknowledges the assistance of "Mr. Justice Benson", Egbert Benson (1746 - 1833), who was the first Attorney General of the state of New York, and later Chief Justice of the New York Supreme Court. The first section, titled 'Rules of the Supreme Court, April Term 1796', lays out 14 rules recently established; the October Term 1797 lists an additional 14 rules. This is followed by the Appointment of Circuit Courts, January 1800 and the dates that they are held in each New York county. Next is a list of costs, titled 'Bill of Costs settled by Judges to serve as Precedents' which includes: Costs on concession of judgment out of court; defendant's costs; costs on judgment by default, and on assessment of damages; and costs of a trial at the circuit or sittings, and judgment thereupon, in the Supreme Court. These costs are all in British currency. The Index provides a guide to the many legal issues embodied in these cases, including Acts, through to Bail, Bail Bond, Certiorari, Costs, Default, Ejectment, Habeus Corpus, Mandamus, Orders of Court, Plaintiff, Petitions, and more.
