Nel dritto francese vi ha, secondo la dottrina e la giurispru denza dominanti, una presunzione di non vitalitą, quando il fan ciullo nasca prima del 180 giorno dal suo concepimento (art. 312 e 314 cod. Fran.) Nel dritto italiano questa presunzione non č pacificamente ammessa. La negano il pacifici-mazzoni (4) e il Serafini i quali sostengono che l'art. 160 del codice civile si riferisce alla presunzione di legittimitą e non a quella della vitalitą, e che il nostro legislatore lascia all'esame e all'apprezzamento par ticolare, caso per caso, la questione sulla vitalitą, senza stabilire alcuna presunzione.
