Why do magistrates and defendants take certain mode of trial decisions? Apart from the extra burdens which Crown Court trials impose on the criminal justice system, comparisons of published statistics suggest that Crown Court trials are more likely to lead to custodial sentences being imposed. This report examines the factors affecting mode of trial decisions and the outcomes. However, there has not hitherto been a study comparing the severity of sentence at the Crown and Magistrates' courts while controlling for the main case factors.
