Relationship breakdown is much more common than it was thirty years ago, and parental separation can have a traumatic effect on children, particularly where there is conflict involved. This Green Paper, published by the Department for Education and Skills, the Department for Constitutional Affairs and the Department for Trade and Industry, sets out the Government's proposals for the system determining parental access to children after a relationship breaks down. The proposals are based on the premise that both parents should continue to have a meaningful relationship with their children after separation, as long as it is safe; and they focus on the needs of the child and how parents can be better assisted to meet those needs during and after separation. Proposals include: introducing parenting plans to give parents good practice advice on parenting arrangements; improving access to legal and emotional/practical advice on how to resolve disputes by telephone and via the internet; developing an in-court concillation system, where courts are focused on problem solving as an alternative to full contested court hearings, where possible; legal aid changes to give incentives for early resolution of disputes; changes to case management procedures in court; better enforcement of court orders; and shifting the emphasis of Cafcass away from writing reports towards active problem solving and supporting agreements.
